Money laundering law news 25/11/2008 Wife found guilty despite denying knowledge of criminal property

A Yorkshire woman, Amanda Brearcliffe, has been found guilty on money laundering charges this week, despite denying all knowledge of her husband Nigels criminal activities. When the verdict was declared, the woman slapped her husband.

Nigel Brearcliffe admitted possession of counterfeit items, offences under money laundering law and possession of criminal property. His wife pleaded not guilty, stating that, had she known of the illegality of her husbands activities, I would have definitely told him to start paying his dues like everybody else and not put our family at risk.

However, the prosecution argued successfully that it was unbelievable that the woman should have thought she was living within legitimate means.

The couple now face confiscation proceedings under the Proceeds of Crime Act 2002, meaning that their Florida home, cars and jewellery will be sold and the proceeds, along with tens of thousands of pounds from several bank accounts, will be seized by the authorities.

Ms Brearcliffes barrister said that his clients misdeeds amounted to turning a blind eye to the money laundering activity of her husband. The judge appeared to agree, saying that he would consider a suspended sentence in her case as she was not the prime mover. The pair will be sentenced on the 11th December.
